THE FOLLOWING DESCRIBES THE TERMS ON WHICH GIXEY OFFERS YOU ACCESS TO OUR SERVICES.
The following policies (showing their last updated date) are incorporated into this Agreement by reference and provide additional terms and conditions related to specific Gixey services we offer:

Each of these policies may be changed from time to time and are effective immediately after we post the changes on our Service, except our Privacy Policy for which we will provide you with thirty days prior notice. In addition, when using particular Services, you agree that you are subject to any policies or rules which are posted in conjunction with those Services. All such posted policies or rules are hereby incorporated by reference into this Agreement.

Gixey does not share or sell your private data to anyone outside of our organization. Our organization includes authorized contractors and Gixey vendors. Your data is used by Gixey to deliver features, services and an overall better experience.
Like you, we do not like getting spam. That is why we will treat your email address the same way that we would like ours treated. Your email address will only be used by us (Gixey) to contact you, as you use our service.
We will never sell or give your email address to anyone outside of our organization, EVER!
We will not use your email address or personal information for anything other than the reasons stated above. Our security measures prevent any of our channel partners, vendors or unauthorized users from having direct access to your private information. Your information is kept private on our secure servers at all times. There may be times where we need to use your information in conjunction with a service from another company (vendor). For example, we may use your email address to send you a scan report and we may use secure services from a Gixey vendor to send that email.
We will never ask for your account information through email. If there is a problem with the Gixey service, please reach out to us via email or other means. We may from time to time, send informational email related to maintenance, new features, service enhancements and/or other Gixey service specific purposes. In the event that we do send an email to you that requires your attention, we request that you contact us directly.
Your payment information is encrypted and stored with our Enterprise-Grade merchant service, and we do not have access to your payment details and do not store payment information on our secure servers. Your other personal information is kept private. We have your site contact information separate from your payment information.

By accepting this agreement you acknoledge and agree with the following:
1) Community Consideration
If you do not follow the below rules in our social communities you will be removed and you will be banned from the site at our discretion.
- No profanity
- No obsceinety of any kind
- No pornography
- No harrasment or discrimination
- No solicitation
- No scamming
Our social engagement is focused on providing support, sharing future service enhancements and connecting with users/subscribers. Be courtious of others when engaging in our social communities. Unacceptable behavior in chat groups and other communication platforms will not be tolerated. Soliciting our users for any service within our communication channels will not be tolerated. If there are aspects of the site that could use some enhancements or modifications please inform our staff so we can try our best to accomodate you.
- Users
This service is specifically designed to quickly scan your broadband network. Some of the services we provide are provided free of cost, while others may require a fee. If you have any sugestions for enhancements please inform our staff so we can try our best to accomodate you.
- Subscribers
We have an API which can be automated as needed and bill based on various usage models. We require that you adhear to our Community Consideration rules. We appreciate feedback from this service also.
- Advertising
We have a few rules on the types of advertising allowed on our site. We respect our users and do not want them to feel that we are throwing tons of flashing ads at them and we certainly do not want our users to be tricked in any way. If one of your ads is flagged as improper (guidelines below) the ad will be pulled from our site and you will be refunded any money paid, minus the services rendered for that month.

1) Guidelines
- No flashy animated ads that blink rapidly or change colors.
- No trick adds (i.e. Your computer may be infected with spyware, Click here to close, and it instead opens)
- No popups
- No spyware, shareware, malware, viruses or other types of malicious or misleading advertising
2) Fair Use
We reserve the right to remove, block or disable access to our services for not adhearing to the following policies.
- no discrimination or other forms of harassment
- no bots, spiders or worms
- no automated tasks what-so-ever! (If you want API access to our application that is a Non-Free Service we offer)
- no buying or selling anything
- no spaming
- no malicious activity
When you use our services, you agree to system monitoring as we attempt to prevent malicious activities.
3) Special Services

Billing
Invoices related to Gixey services will originate from Kleenscape, LLC.
Third Parties
To support our free services, Gixey provides basic web advertising. Gixey has no responsibility for, or control over Third Party Websites external to Gixey. These ads, listings, services or other sites, when clicked or visited, may send you to a page that is not located on the Gixey network and may not adhear to our policies. In no event shall Gixey be liable for any damages resulting from use of our services even if Gixey has been informed of the possibility of such liability. Since we cannot guarantee any particular level of functionality, useability, reliability or security from anywhere on the Internet, we are not liable for any damages incured. Gixey is not responsible for user behavior on or off our site. Since we cannot control the actions of our users, we will at our discretion act accordingly to any questionable behavior once it is brought to our attention. Gixey as a service, is a datapoint in the pursuit of a reliable InfoSec methodology. There are far too many external factors that are outside of our control for Gixey to make guarentees. Using Gixey services can help you safeguard your network connectivity and when used properly can help identify new threats quickly. Our 24x7 broadband network monitoring service will constantly check for open ports and notify when open ports are identified.
Although precautions have been made to ensure our data is accurate and secure, Gixey makes no promises or warranties of any kind, expressed or implied, with regard to the accuracy of our services or Third Parties. We are, however, responsible for the security of your private data stored in our system. We have taken many precautions to prevent the compromise of your private data, but cannot guarentee that data cannot be compromised. Even though we can and will disable or delete user accounts at our discretion, if our agreements are broken and we are notified, we reserve the right to remove, de-activate or pursue legal actions against any wrongdoers.
Service Availability
We offer our service to you, AS-IS, if you choose to use our service then you do so at your own risk. Our service may become unavailable from time to time, to perform maintenace or during a network related problem. Because of this, we offer no service level or up-time guarantees. If you need to have a certain level of access to our site then you need a support contract so you may work with us more closely in the event of a problem.
In order to mitigate the risk of any problems, site visitors are strongly advised to have up-to-date virus/spyware detector software properly configured and tested.
